1. Overview

By accessing or using our website and services, including virtual assistant support, cohosting for short-term rental hosts, and digital product downloads, you agree to be bound by these Terms of Service. These terms apply to all site visitors, customers, and users of ListSplit Solutions, LLC ("we," "us," or "our").

2. Eligibility

You must be at least 18 years old to use our services or purchase from our site. By using our services, you represent that you are of legal age and capacity to form a binding contract.

3. Services Provided

We offer:

  • Virtual assistant and support services for short-term rental (STR) hosts

  • Cohosting services

  • Digital product downloads (e.g., templates, resources for STR operations)

Service delivery methods:

  • Digital products are delivered by instant download or email.

  • Cohosting and virtual assistant services are coordinated through platforms like Airbnb, VRBO, or direct email communication, depending on the client.

4. Payments & Billing

Payment is accepted via HoneyBook or Wave. Services may be billed:

  • Monthly

  • Annually

  • In 4-month prepaid bundles

You are responsible for timely payments in accordance with your selected plan.

5. Refund Policy

  • We offer a 30-day satisfaction guarantee for new virtual assistant and cohosting clients. If you are not satisfied during your first month of service, a full refund may be requested.

  • No refunds will be issued after the first month of service.

  • All digital product purchases are non-refundable.

6. Client Data & Privacy

We collect basic personal information and limited business data (e.g., occupancy rates) to provide our services. We do not share this information with third parties unless required by law. Please see our [Privacy Policy] for more details.

7. Use Restrictions

You may not:

  • Resell, copy, or redistribute our digital products or templates

  • Use our services for any unlawful or fraudulent purposes

  • Impersonate others or misrepresent your affiliation

We reserve the right to terminate access to services if these terms are violated.

8. Legal Disclaimers – What We Are Not

  • We are not a licensed real estate brokerage or property management company in the state of North Carolina or any other jurisdiction.

  • We do not market, list, lease, or rent properties on your behalf.

  • We do not collect rent or handle security deposits.

  • We do not negotiate pricing or terms with guests or third parties.

  • We do not approve or reject guests on your behalf.

  • We do not represent clients in legal matters, including landlord-tenant disputes, eviction proceedings, or court appearances. Clients are solely responsible for compliance with applicable laws and regulations.

  • We do not disburse or manage funds on behalf of clients. All refunds, payouts, or financial transactions must be handled directly by the property owner or through STR platforms.

9. Legal Limitations of Services

In compliance with the North Carolina Real Estate Commission (NCREC) and STR platform policies, we do not perform the following activities (this can be subject to change at any time):

A. Money Handling

  • ❌ Collect rent, security deposits, or guest payments

  • ❌ Disburse funds on behalf of the owner (including payouts and refunds)

  • ❌ Collect cleaning fees or extras directly from guests

  • ❌ Charge commission or percentage-based fees linked to bookings

B. Contracts & Representation

  • ❌ Sign, negotiate, or modify lease or rental agreements

  • ❌ Create or enter into property management agreements

  • ❌ Market properties on behalf of multiple owners as a business

C. Booking & Pricing Control

  • ❌ Accept or decline guest reservations

  • ❌ Set or adjust nightly rates

  • ❌ Block or unblock dates for financial gain

D. Guest Communication Boundaries

  • ❌ Serve as the main guest contact if compensated per stay/reservation (flat fee/hourly is allowed)

E. Platform Compliance

  • ❌ Log into host accounts using host credentials

  • ❌ Create duplicate or fake host profiles

  • ❌ Conceal third-party status as a cohost or assistant

10. No Guarantees or Warranties

We do not guarantee that using our services or digital products will result in increased bookings, revenue, or other business improvements. All services and materials are provided “as is” without warranties of any kind.

11. Chargebacks & Disputes

If you initiate a chargeback without first contacting us to resolve the issue, we reserve the right to dispute the claim. Legal action may be pursued to recover lost revenue if chargebacks are determined to be fraudulent or in violation of this agreement.

12. Limitation of Liability

To the fullest extent permitted by law, ListSplit Solutions, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or products.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.

14. Modifications

We reserve the right to update these Terms at any time. Continued use of our website or services following the posting of changes constitutes acceptance of those changes.
